“3 Hebrew Boys” Scammers Found Guilty by SC Jury

A federal jury found the “3 Hebrew Boys” namely Timothy McQueen, Joseph Brunson and Tony Pough guilty of fraud in a South Carolina Court. The men were accused of bilking investors out of $80 million dollars in various illegitimate schemes which carries heavy prison penalties and fines.

The jury of four men and eight women deliberated for less than 4 hours on Friday regarding nearly 60 charges that include mail fraud, money laundering and conspiracy.

The men called themselves the “3 Hebrew boys” after the biblical tale of the three men who were tossed into an inferno and survived because of their religious faith.

The next phase of the trial will involve how much reparation the men will have to pays out for their crimes. The men also face years in prison but remained stoic and unemotional as the fifteen minute verdict was read.

$3 Million Dollar Settlement Awarded to Assault Victim Against KBR

Tracy Barker, the woman who sued Haliburton and several affiliates in May 2007 after she was sexually attacked by a state department employee was awarded 3 million dollars this week. Court records indicated that the woman was awarded the judgment of $2.93 million to settle her arbitration claim against the corporation.

Barker was working as a civilian contractor in Basra, an Iraqi City when she was raped by a fellow state department worker. The ensuing lawsuit had been initially dismissed by a court Judge in January of 2008 because the contract she signed with the company stated that criminal and legal matters would be handled through arbitration and not the American court system.

KBR disagreed with the ruling and said that it would file a motion to modify the award. An official spokesperson for the company pointed out that the ruling did show that the arbitration process could be fair and impartial.

Neither Barker nor her attorney could be contacted after the ruling.

British Police Offer Settlement to Family of Slain Suspect

The family of a slain Brazilian man who was mistaken for a terrorist and shot has reached a settlement with the London Police department regarding the incident.

Brazilian native Jean Charles de Menezes was killed July 22, 2005 by British Officers when they mistook the young man to be a suspect in terrorist attacks. This came the day after an ambush on the city’s transit system by an unknown militant group.

London Police chief Paul Stephenson and the Menezes family issued a joint statement acknowledging their financial arrangement and stating that both sides were pleased with the outcome. A wrongful death lawsuit was subsequently dropped against the department.

As per the terms of the arrangement, neither side will disclose the specifics of the settlement agreement.

Danvers Mass. Explosions Prompt Residents to File Lawsuits

Danver Massachusetts residents Deborah Riva and Robert Corrieri are seeking to file a class action lawsuit against Covington, KY based Ashland Inc., who were responsible for a blast that damaged their property. Riva, who lost her home and Corrieri, whose boat was damaged, are heading litigation in a Salem Superior Court against a company that provided chemicals to a local factory. Those chemicals were the catalyst for a blast that damaged more than 270 homes and businesses in 2006.

In the suit, the duo alleges that Ashland Inc. provided extremely dangerous solvents to a local facility that could not handle them, nor were they licensed to do so.

The resulting eruption that was heard for more than 20 miles leveled the local factory and knocked homes off foundations. CAI Inc. and Arnel Co., the local businesses that shared the space that was destroyed, reached a $7 million dollar settlement with area residents.

Ashland Inc, who did not return phone calls on Monday, has officially stated thet they weren’t liable for resulting damages caused by the blast.

Craigslist Shielded Against Erotic Services Lawsuit

An Illinois based federal judge granted Craigslist a motion for a judgment over the website’s ex “erotic services” listing. Seeking financial award under the Communications Decency Act, Thomas Dart, the Sheriff of Cook County Illinois, filed a lawsuit against Craigslist alleging that its erotic services category helped perpetuate prostitution. Thomas Dart is seeking an injunction prohibiting Craigslist from publishing erotic services listings. The sheriff also desires financial compensation for the money that his office has spent investigating prostitution occurring on the site.

Soon after the suit was filed, Craigslist changed the title to “adult services” and instituted a review process for postings in that particular category. Sheriff Dart argued that the changes did not eliminate the problem.

Illinois district Court Judge John Grady ruled that Craigslist was shielded from liability by section 230 of the Communication Decency Act which states that a provider of an interactive service can’t be held accountable for what transpires via third party material. Responsibility then falls onto the shoulders of the person posting the content, not the website providing the services.

The ruling means that Thomas Dart cannot recover financial damages from Craigslist under the stipulations of his suit.

Million Dollar Verdict Upheld For McDonald Employee who was Strip Searched

A Louisville Kentucky appellate court upheld a ruling that awarded a fast food employee $6 million dollars after she was wrongfully strip searched and sexually assaulted. Victim Louise Ogborn, then 18, was forced to strip naked when someoen called the McDonald’s she was working at pretending to be a police officer.

Ogborn received the call while on shift during which she was assaulted by Kentucky resident Walter Nix Jr., the fiance of an assistant manager who also worked there. Nix served a prison sentence of the assault. The man who actually placed the call, one David Stewart, was acquitted of all charges. Of note was the fact that many harassing hoax calls stopped shortly after Stewart, a Florida man, was arrested.

The Kentucky appellate court upheld the $6 million dollar judgement against McDonald’s Corp because officials knew about the series of hoax phone calls to restaurants around the US but failed to warn employees. They ruled that to reverse the decision would undercut the weight and validity of evidence in the case

Louise Ogborn fell victim to the call in 2004.

A McDonald’s spokesman and Ogborn’s attorney, Ann Oldfather, were contacted for reactions to the ruling. Neither returned messages and phone calls regarding the matter.

Man Wrongfully Imprisoned seeks Financial Restitution

A man who was wrongfully convicted and imprisoned for 27 years is seeking monetary compensation for his pain and suffering.

Former inmate William Dillion is asking for a settlement in the upper millions of dollars for a conviction that landed him in a Brevard county correctional facility. Although DNA exonerated him from the 1981 murder of James Dvorak, Dillion may have difficulty receiving reparation because of a prior felony drug conviction.

Freed last November, a Tallahassee court heard the case last week, where Dillion stated that it would be impossible to place a dollar amount on his freedom.

Family Awarded $6.74 million for Fatal ADM Accident

A Decatur Illinois jury decided that agribusiness company Archer Daniels Midland Co. would pay wrongful death restitution to the family of a 26-year-old man who was killed at one of their plants. They awarded the grieving family $6.74 million dollars for the March 2007 death of Francisco Moreno Garcia this past Friday at the Macon County Court in Decatur.

The tragic work related accident occurred March 23rd 2007 as Garcia attempted to install insulating pipes at one of the Decatur based ADM facilities. A nearby machine malfunctioned and sprayed the man with hot fluid and steam. Fellow co-workers tried to help him by getting him into the safety shower but the man’s skin was peeling off in strips.

Garcia died at the hospital and was said to have burns over 90 percent of his body.

An ADM spokesperson expressed a desire to consider an appeal to the award, but offered their sympathy to Garcia’s family.

Spinach Companies Sued by Wisconsin Woman after E. Coli Outbreak

85-year-old Jane Majeska of Fond du Lac, Wis. is suing California spinach growers and shippers after eating a tainted batch of the leafy green. The Spinach was riddled with E. Coli which killed three people and sickened 200 nationwide.

In Jane’s Majeska case, she ended up on a ventilator and feeding tube after developing hemolytic uremic syndrome from consuming Dole Spinach in August of 2006. Dole representatives declined to comment, citing that it was their policy not to discuss pending litigation with the public.

The product liability lawsuit Majeska filed this past Thursday sought an untold sum in financial damages from Dole, Natural Selection Foods, Mission Organics and Pic-n-Save.

The outbreak prompted an investigation from the U.S. Department of Agriculture who sought to improve the conditions that lead to the epidemic. Officials recently announced that the USDA was considering a new proposal that proponents say can keep bacteria-tainted greens from reaching grocery shelves.

The industry lost 80 million in sales after the outbreak.
