RI Prosecutor Refuses Breathalyzer Test

A Rhode Island police chief says that his department is currently investigating whether a federal prosecutor used his position of authority to escape a DUI charge. The prosecutor reportedly failed sobriety tests and refused a breath test after being stopped by an officer. Assistant U.S. Attorney General Gerard Sullivan was stopped Thanksgiving morning for erratic driving. He told the officer he had been drinking.

Sullivan has been charged with refusing a breath test, but not a DUI. The police chief says that it is typical to charge those refusing breath tests with a DUI. Sullivan’s lawyer says that he made a mistake, but that he did not receive any kind of special treatment.
