No Drug Money Case Against Fla. Defense Lawyer
In a ruling that marked the first of its kind, a federal panel for appeals sided with a Florida defense lawyer who was accused of giving advice to attorneys for an accused Medellin cocaine cartel boss. The court ruling on Monday put defense lawyers at ease, as many had worried that a successful prosecution would force them to stop taking cases for defendants whose financial holdings were suspect.
The ruling was significant because no federal court had as yet ruled in a similar type of case. “This is a huge win not just for Ben Kuehne but for criminal defense lawyers,” said David O. Markus, a Miami attorney who helped write a friend of the court brief on Kuehne’s behalf for the National Association of Criminal Defense Lawyers.
