NJ Judge Allows Paralyzed Man to Keep His Guns
A Somerville NJ Judge ruled that a quadriplegic man could keep his guns even though he could not use them. The judgment came after a Manville police chief refused to issue 46-year-old James Cap a firearm ID to purchase weapons. The chief rejected his application due to safety concerns after he learned that Cap wanted to put the gun on a wheelchair mount and operate it with a breathing tube during a hunting trip.
James Cap, who was paralyzed 30 years ago after breaking his neck during a football game, was an avid hunter as a teen and wanted to enjoy the sport once more
The NJ judge stated that Cap had the right to bear arms and could not be denied the ability to own a gun. Safety concerns were addressed when the judge required the man to keep his weapons in a safe. Whenever Cap wants to remove and utilize them, he would have to do so via the assistance of people qualified to do so.
