Man’s “Fat Defense” Fails, Faces Sentencing
A Florida man whose attorney claimed that he was simply too fat to have shot his son-in-law and escaped will be sentenced in New Jersey. A jury convicted Edward Ates of shooting and killing Paul Duncsak in the latter’s New Jersey home. Ates’ defense was focused on the idea that he was not in sufficient physical shape to run up and down the stairs to shoot Duncsak, and then escape by driving over twenty hours to his mother’s home in Louisiana.
Ates was sixty-two years old and weighed two hundred eighty pounds when Duncsak was killed.
