Important Claim Against Fosomax Dismissed
Releasing a statement on Tuesday, Merck & Co. revealed that a U.S. district court dismissed claims against the company in a second “bellwether” or “key” regarding the drug Fosomax. As of Sept. 30, the company has been fighting 953 lawsuits which allege that their osteoporosis drug Fosamax causes a painful ailment called osteonecrosis of the jaw. The disorder culminates in a loss of blood to the bones, permanently damaging them.
U.S. District Court Judge John F. Keenan granted Merck summary judgment in the case stating that the plaintiff’s physician was unqualified to render an opinion in the matter. He also indicated that the evidence presented was insufficient to show a causal link between Fosomax and osteonecrosis of the jaw.
Fosomax has been approved to treat the thinning of bone tissue and loss of bone density.
