Illinois High Court Green Lights “Jews Only” Inheritance
The Supreme Court of Illinois recently ruled that a Jewish husband and wife who had set up their estate to disinherit any grandchildren who married outside their faith were fully within their rights to do so. Max Feinberg, a dentist in Chicago, and his wife had changed their estate to disinclude anyone who married a non-Jew. Out of their five grandchildren, four had married spouses who were not members of the Jewish faith, and therefore were not granted any inheritance.
The argument was raised in the courtroom whether it was right to allow wills to interfere with or even determine who someone marries based on religious choice. The argument was rejected by the court on Tuesday, though the ruling was based largely on particular technicalities with the estate itself, which means that other cases of a similar nature might not be dealt with in the same fashion.
