High Court in NY to Consider Same-Sex Marriage Benefits
A high court in New York will hear arguments against providing government benefits to same-sex marriage couples that were married in Canada and other jurisdictions where their marriages are legal. The state Department of Civil Service has extended health benefits to the spouses of state and local government employees since 2007, and a year earlier similar recognition and benefits were granted in Westchester County.
The Court of Appeals will hear arguments on Tuesday by the Alliance Defense Fund of Scottsdale, Arizona. The arguments will contend that granting these benefits is unlawful in New York, which currently does not permit same-sex marriages. Lower courts have upheld the benefits granted, saying that New York generally recognizes marriages that are performed and permitted elsewhere unless they are specifically prohibited.
