Ex-Worker Revives Lawsuit Against Union Pacific Railroad
A worker who claims that Union Pacific Railroad could have done more to protect her from the West Nile virus has been granted the opportunity to continue to pursue the matter in court. The original lawsuit, which had been dismissed by a Douglas County district judge, was revived by the Nebraska Court of Appeals who felt the matter should have been brought before a jury.
Former employee Vivika Deviney’s, who contracted the illness while working near railroad tracks, asserts that Union Pacific Railroad did little to safeguard workers from mosquitoes near a track in Wyoming. Because of this, she feels they are liable for her injury.
On the opposite end, Union Pacific Railroad argues that they could not prevent West Nile virus or the migration of disease carrying insects.
