Court to Make Decision on Miranda Rights Expansion
The Supreme Court will be making a decision on how far police questioners are allowed to go when suspects state that they have understood their Miranda rights but have not chosen to invoke them. The decision was spurred by the arrest of Van Chester Thompkins. The suspect did not immediately ask for a lawyer and did not state he didn’t want to talk to police after being read his Miranda rights after being arrested for murder. He eventually confessed and was convicted.
During his appeal, however, he stated that his Miranda rights had been violated. The conviction was thrown out by the 6th Circuit United States Court of Appeals in Cincinnati, saying that since Thompkins did not actually waive or assert his Miranda rights, the questioning should have been stopped.
