City of San Diego not Responsible for Mud Slide Judge Rules

A San Diego judge ruled Thursday that the city cannot be faulted for a landslide that damaged homes and destroyed property in a La Jolla neighborhood.  In the incident several homes were affected and at least 3 were demolished after a 50 yard stretch of road collapsed in October 2007.

Homeowners alleged that the landslide, which occurred two years ago, was caused by a leakage in city water pipes. The 65 homeowners were seeking $100 million in damages collectively for the damages they incurred.

Superior court judge Ronald Styn indicated that the homeowners failed to provide a causal link between the landslide and the city water pipes leakage.  Without that information he could not find in their favor as they did not sufficiently prove their case.

Whether or not the homeowners would appeal the decision is not known at this time.
