Tow Truck Crashes into Restaurant

A tow truck carrying a pickup truck on its bed crashed into the front of a Yoshinoya restaurant in the Wilshire Center Area, Los Angeles, at around 10:40 a.m. Thursday, July 2011. Officials stated that six people were injured in the incident, one
critically. Paramedics transported five of the six injured to an area hospital. The cause of the crash is under investigation. It is unknown whether the driver of the tow truck was speeding, under the influence of alcohol and/or drugs, suffered a seizure or other medical event, experienced brake or other equipment failure, was texting at the time, or whether
there was another cause of the incident.

In cases such as this, the legal doctrine of res ipsa loquitur – the thing speaks for itself – is usually relied upon by the victims’ lawyer to presume carelessness (“negligence”) on the part of the driver, as under ordinary circumstances a truck would not crash into the front of a restaurant or other store in the
absence of carelessness of the driver.

San Diego Boat Accident Turns Deadly

On March 27, 2011, a 26-foot boat carrying 10 people on a tour of San Diego Bay capsized, resulting in the death of two people. On Wednesday, July 27, 2011, the San Diego Harbor police released a statement attributing the incident to too many people on board the boat and the condition of the boat and its equipment. The 26-foot vessel was a 1988 MacGregor model that was owned by a non-profit corporation that provided sailing excursions for people with special needs.

The corporation that owned the boat and the operator may be monetary liable to the deceased passengers’ next of kin on the basis it was careless (“negligent”) in allowing too many people on the boat and for failing to keep the boat and its equipment in good condition.

When the boat capsized, all 10 aboard were thrown into the water. The surviving passengers may also hold the corporation and operator liable for any physical injuries they suffered, as well as severe emotional distress resulting from the tragedy.

Drunk Driver Kills Bicyclist in San Diego

On Wednesday, July 27, 2011 a driver was arrested in San Diego County after she allegedly struck and killed a bicyclist, then tried to escape the scene by hiding in some bushes. The driver was suspected to be under the influence of alcohol. Authorities stated that the 23-year-old female driver was arrested around 10:00 pm. Wednesday on suspicion of DUI, manslaughter, and hit-and-run driving. Authorities stated that the 64-year-old bicyclist from Vista, California, was struck on El Camino Real.

A witness called 911 and arriving officers found the unoccupied vehicle in a nearby apartment complex.
The driver was found hiding in some bushes. In addition to suing the driver for the traditional damages – medical expenses, funeral expenses, lost wages, and loss of comfort and consortium – the survivors may be able to recover punitive damages from the driver to her callous disregard of the law by driving while intoxicated.

Las Vegas Helicopter Tour Crashes; 5 Dead

In a horrific crash, a luxury helicopter tour crashed near Hoover Dam during a sunset trip leaving the pilot and four passengers dead. The cause of the crash is not yet clear and Federal Authorities are on their way to Las Vegas to investigate and determine the cause.

The helicopter is owned and operated by Sundance Helicopter Company which is based out of Las Vegas Nevada.

Arizona Shooting & The 2nd Amendment

In 2008, the United States Supreme Court ruled that the Second Amendment to

the Constitution protects the right of individuals to keep and bear arms for the purpose of

self-defense.

On Saturday morning, January 8, 2011, 22-year-old Jared Lee Loughner,

armed with a 9-millimeter Glock semi-automatic pistol and 90 rounds of ammunition,

opened fire on a political rally, killing 6 people and wounding 14 others. The target of

Loughner’s terrorist act was Congresswoman Gabrielle Giffords, whom he shot in the

head. The bullet passed through her brain, but she was holding her own three days later.

While guns and rifles are permitted for self-protection, it is clear that semi-

automatic and automatic guns and military-style weapons should be banned. They don’t

call these types of arms assault weapons for no reason. They are used by fanatics, drug

dealers, murderers, and other criminals to commit crimes, not for self-protection.

Congress should act swiftly and pass a law making it illegal to own or possess these

dangerous weapons.

The right to defend oneself and one’s family from intruders is one thing. The right

to own or possess semi-automatic and automatic weapons such as a 9-millimeter Glock

with a removable magazine or an AK-47 is something entirely different. Write your

Congressperson and Senator today and urge them to immediately pass a law banning

these weapons of assault, not self-protection.

Cleveland Suspect Withdraws Insanity Plea

A Cleveland man charged with killing 11 women and hiding their remains in and around his home has withdrawn his plea of not guilty by reason of insanity. Anthony Sowell’s plea was changed to not guilty during a pretrial hearing on Wednesday. Defense attorney John Parker tells The Plain Dealer newspaper that the switch was made after the judge asked if Sowell could be sent to a psychiatric clinic for evaluation.

Parker says it’s too early for that because the defense still doesn’t have Sowell’s military, medical or prison records. He tells the paper the plea could be changed back to not guilty by reason of insanity once Sowell’s attorneys have all the information.

Court Throws Out Death Penalty for Slayer of Three

The Arkansas Supreme Court has ordered a new sentencing for a death row inmate convicted of killing his girlfriend and her two young children around the holidays in 2006. Justices on Thursday upheld James Aaron Miller’s murder conviction but ordered that he be resentenced. Miller was convicted of killing Bridgette Barr, 5-year-old Sydney Barr and 2-year-old Garrett Barr while the children visited their mother in Fort Smith for Christmas. The children lived with their father in Oklahoma.

Justices ruled that two witnesses should not have been allowed to recommend that the jury impose the death penalty during the sentencing phase. Justices rejected Miller’s argument that the bodies were discovered during a warrantless search of his apartment.
