Poll: More US Voters want Arizona-like Laws

In a National Poll conducted by Quinnipiac University, reveals that more American’s want similar laws enacted as the controversial Arizona law that is set to take effect on July 7, 2010. The Arizona law gives law enforcement officials, and more specifically, the police the ability to question the resident status of any suspected illegal immigrant.

Such a law is argued to be in direct contradiction to the US Constitution and has drawn media and political attention.

Merck Argues Investors Can’t Sue over Vioxx Drug

Merck and Co., the makers of Vioxx argued in court this week that investors can’t sue them for the defunct product because the statute of limitation is over for a defective drug lawsuit. Vioxx, which was pulled off the market because it doubled the risks of heart attack, stroke and death cost the company and its investors tens of billions of dollars in shareholder values.

This occurred almost overnight, lost overnight when Vioxx was taken out of circulation.

Merck and Co., indicated in a statement to the Supreme Court that shareholders failed to pursue litigation after the risks about the drug were revealed. They then and asked the court to waive the class action securities suit being brought against the corporation arguing that the 2-year statute of limitations had passed.

A lower court initially agreed with Merck, but an appellate court reversed the decision sometime later.

The case is currently before the Supreme Court and will be ruled on within the next year.

20-Year-Old Woman Sues Hospital over Amputations

20-year-old Shanna Hiles’ filed a medical malpractice suit on Tuesday against Uniontown Hospital of Western Pennsylvania claiming the emergency room doctors failed to properly treat her. Hiles, who had drank herself unconscious celebrating her 20th birthday in May, was taken to the emergency room shortly after passing out.

During her hospital admittance she passed out again with her legs tucked under her, remaining in that position for 12 hours. The hospital failed to diagnose her condition and both of her legs were partially amputated. Hiles indicated that all they needed to do was restore circulation to her legs to remedy the situation and amputation was not necessary.

Instead, the hospital opted to send Hiles to a Pittsburgh facility where both legs were amputated at the knee.

No official response has been issued on behalf of Uniontown Hospital since the court filing on Tuesday.

Sex Offender and Murderer Waives Right to a Speedy Trial

50-year-old Cleveland Ohio resident Anthony Sowell waived his right to speedy trial to accommodate a new defense team this week. Sowell, a registered sex offender who is charged with killing 11 women, also agreed Wednesday to allow police onto his fenced off property to preserve evidence.

The suspected serial killer put in a plea of not guilty by reason of insanity at his pretrial hearing prior to his request.

Investigators revealed that Sowell spent several years luring women to his Cleveland home where he then attacked and killed them. Ten of the victims skulls were found in the murderer’s home or buried in the yard.

Sowell faces 85 counts including murder, rape, assault and abuse of a corpse. He will also be charged with assault and attempted murder in regards to the three women who survived his attacks.

If convicted, Sowell could get the death penalty.

The waiver pushes back the Sowell trial court date to mid-2010.

NY Teen Charged with Hate Crime in Immigrant Stabbing Death

A New York city teen pleaded guilty to a gang related assault that resulted in the stabbing of a Ecuadorean immigrant. In a plea bargain arrangement, Jose Pacheco agreed Wednesday to testify against other members of the gang who had a hand in the killing. The victim, Marcelo Lucero, was a dry cleaner who lived and worked in the Patchogue N.Y. area.

On Nov 8, 2008 he was stabbed in the chest by Pacheco and six others who went looking for a Latino victim. Pacheco is not the only member of the gang to arrange a deal in return for his testimony. Last month another defendant in the assault pleaded guilty to conspiracy and hate crimes as well.

The case received a national spotlight due to the nature of the crime and the motivation behind it. The attention prompted the U.S. Justice department to investigate instances of rate crimes and police response to them with the goal of spreading awareness on the issue.
